These Terms and Conditions (“Terms”) govern your access to and use of the ROZ Health website (www.rozhealth.in) and any purchases of products by Nutribloom Health Private Limited (“ROZ Health,” “we,” “us,” or “our”). By accessing the Site or placing an order, you agree to be bound by these Terms, along with our Privacy Policy. These Terms constitute a legally binding agreement under the Indian Contract Act, 1872 (read with Section 10A of the Information Technology Act, 2000). The Site is operated from India and conforms to applicable Indian laws, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019 (and associated E-Commerce Rules, 2020). If you do not agree to these Terms, do not use the Site. We reserve the right to modify these Terms at any time by posting an updated version on the Site; your continued use of the Site after such changes means you accept them.

1. Eligibility and User Obligations:

This Site and its services are intended for users who can form legally binding contracts under Indian law. You must be at least 18 years old (or a minor with guardian supervision) to use this Site. If you are under 18, you should use the Site only with the involvement of a parent or guardian, as contracts with minors are void under the Indian Contract Act. By placing an order or using the Site, you represent and warrant that you meet these requirements. You agree to provide accurate, current, and complete information as prompted, including when registering an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately if you suspect any unauthorized use of your account. You agree to comply with all applicable laws in your use of the Site and Products, including age and payment laws. You may not use the Site for any purpose that is unlawful or prohibited by these Terms.

2. Product Use (Personal Use Only; Resale Prohibited):

All products available on the Site are intended for your personal, non- commercial use only. You agree not to purchase products for resale or redistribution. Any bulk orders must still be for genuine personal consumption and comply with the “no resale” policy. We reserve the right to cancel or limit orders that we suspect violate this policy, such as unusually large orders or orders that appear intended for commercial resale. Misuse of purchased products or violation of this provision may also result in termination of your account.

3. Accuracy and Content Disclaimer:

We strive to ensure that all information on the Site including product descriptions, pricing, images and other content is accurate and up-to-date. However, errors or omissions may occur. We do not warrant that any content is error-free or complete. Prices and availability of products are subject to change without notice. All content on the Site is provided “as is” for general informational purposes only. Neither ROZ Health nor its affiliates or suppliers make any representations or warranties (express or implied) about the accuracy, reliability or completeness of any content, nor about any links to other websites. You acknowledge and agree that your use of the Site and its content is at your own risk.

4. Pricing, Payment, and Cash-On-Delivery (COD) Limits:

All prices are indicated in Indian Rupees (INR) and include applicable taxes unless otherwise stated. We make reasonable efforts to ensure pricing information is correct, but mistakes can happen. In case of an error, we reserve the right to cancel your order and notify you of any pricing discrepancies. We accept payment by authorized credit/debit cards, net banking, UPI, and other payment methods as offered on the Site. For Cash-On-Delivery (COD) orders, a maximum limit applies (e.g. currently ₹2,000 per order, or as mandated by Reserve Bank of India guidelines). By selecting a payment
method and proceeding to checkout, you authorize us to charge your chosen payment source for the full order value (including taxes and any applicable shipping charges). All payments must be made in full at the time of order. If a payment is not successfully completed (for example, due to expiration or insufficient funds), we may cancel the order. If you cancel a prepaid order, we will refund the purchase price (minus any transaction charges) in accordance with applicable law and our Refund Policy. All refunds will be processed promptly per RBI guidelines .

5. Order Acceptance, Rejection, and Cancellation by ROZ Health:

Once you place an order, we will send an email confirmation. Acceptance of your order (forming a binding contract) occurs when we dispatch the products. We reserve the right to accept or decline orders at our discretion. We may refuse or cancel orders for reasons including, but not limited to: product unavailability; problems with payment authorization; suspected fraud; pricing errors; or any violation of these Terms. If we cancel an order that you have already paid for, we will refund the full amount without any cancellation fee. In line with the Consumer Protection (E-Commerce) Rules, 2020, we do not charge cancellation fees to consumers, and if we cancel your order, you will
not be responsible for any costs . If you cancel an order yourself (before dispatch), we may deduct any necessary payment gateway or shipping charges as permitted by law, and refund the balance.

6. Intellectual Property:

All content on the Site – including text, graphics, logos, images, videos, audio clips, designs, trademarks, and the compilation thereof – is the property of ROZ Health or its licensors and is protected by copyright, trademark, and other intellectual property laws. “ROZ Health” and our logos are registered trademarks of Nutribloom Health Private Limited. You agree not to copy, reproduce, republish, upload, post, transmit or distribute any content from the Site in any way without our prior written consent. You may not use any metatags or any other “hidden text” using ROZ Health’s name or trademarks. Any unauthorized use terminates the licenses granted by these Terms.

7. Prohibited Conduct:

When using the Site or our services, you agree not to:

• Use any automated means (such as bots, spiders, or scrapers) to access or copy any content from the Site.
• Interfere with or disrupt the Site or servers (e.g. by introducing malicious code, hacking, or launching denial-of-service attacks).
• Use the Site in any unlawful manner or to violate any law, third-party rights, or our policies.
• Post or submit any false, misleading or defamatory information. In particular, you may not post fake reviews, ratings or testimonials about products or services (including impersonating other users or misrepresenting facts) .
• Circumvent any measures we may use to prevent or restrict access to the Site.
• Engage in any harmful or illegal activities (for example, fraud, money laundering, or resale in violation of law). Violation of any of the above may result in termination of your access to the Site and legal action.

8. Health Disclaimer and Product Liability:

Our products are health supplements and food items intended for general wellness. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Under Indian food safety regulations, no medicinal claims may be made for dietary supplements . You should consult a qualified healthcare professional before starting any new dietary supplement, especially if you have a medical condition or are pregnant or nursing. Each product has a shelf life (typically up to 24 months from the date of manufacture) clearly printed on its packaging. You agree to use the products before their expiry date and as directed. ROZ Health is not liable for any injury, loss or damage arising from improper use or storage of the products. If you receive a product that is defective or damaged, contact us promptly for a replacement or refund as per our Refund/Returns Policy (see below).

9. Limitation of Liability:

To the fullest extent permitted by law, ROZ Health and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, punitive or consequential damages, or loss of profits, data or business opportunities arising from or related to your use of the Site or the purchase or use of any products. Our total aggregate liability for direct damages will in no event exceed the amount paid by you for the specific product or order giving rise to the claim. This limitation applies even if we have been advised of the possibility of such damages. Any attempt to limit our liability to an unreasonably low amount has been held unenforceable by courts , but where liability cannot be excluded by law, it is limited to the maximum extent permitted by law. Nothing in these Terms shall exclude or limit liability for death or personal injury caused by our negligence, or for fraud, or any other liability which cannot be excluded or limited by applicable law.

10. Indemnification:

You agree to indemnify, defend, and hold harmless ROZ Health and its affiliates and their respective officers, directors, employees, agents and representatives from and against any and all claims, losses, liabilities, damages, and expenses (including attorney’s fees) arising out of or relating to: (a) your breach of any of these Terms; (b) your violation of any law or third- party right; (c) your use or misuse of the Site or products; or (d) your violation of the “Prohibited Conduct” above. This indemnification obligation will survive termination of your account and use of the Site.

11. Modification of Terms:

We may revise these Terms at any time by updating this page. We will give notice of material changes by posting a prominent notice on the Site or by sending you an email if you have an account. You should review these Terms periodically. Your continued use of the Site after any change constitutes acceptance of the new Terms. If you do not agree to any change, you should cease using the Site immediately.

12. Governing Law and Jurisdiction:

These Terms, and any dispute arising from them or your use of the Site, are governed by and construed in accordance with the laws of India. The courts in Ahmedabad, Gujarat shall have exclusive jurisdiction to resolve any disputes, to the extent permitted by law. If any provision of these Terms is found to be invalid or unenforceable under applicable law, such provision will be struck out without affecting the enforceability of the remaining provisions. In matters of choice of law, Indian laws cannot be excluded .

13. Grievance Redressal and Contact Information:

Our Grievance Officer will acknowledge your complaint within 48 hours
and endeavor to resolve it within one month as required by law . If your
grievance is not addressed satisfactorily, you may approach the
appropriate Consumer Forum or legal authority.

14. Returns and Refunds:

Products may be returned for a refund or replacement only if they are defective, damaged, or do not match the description on the Site. To initiate a return, contact our customer care immediately with proof (photos, order details). We will assess the issue and, if eligible, provide instructions for returning the product at our expense. Refunds will be processed by the original payment method or as store credit, as per our policy. As required by the E-Commerce Rules, we will accept returns and provide refunds for products that are defective or not as described . You will not incur any additional costs for a return of such items, except as disclosed. Orders cancelled by you before dispatch may incur reasonable fees (e.g. payment gateway charges), whereas orders cancelled by us are fully refunded.

15. Miscellaneous:

These Terms (along with any referenced policies) constitute the entire agreement between you and ROZ Health regarding the use of the Site and purchase of products, superseding any prior agreements. No waiver of any term or condition in these Terms will be effective unless made in writing and signed by an authorized representative of ROZ Health. Our failure to enforce any right or provision will not constitute a waiver of future enforcement of that or any other provision. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

By using the ROZ Health website or purchasing our products, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
